Carlo 28 - 40023 Castel Guelfo di Bologna (BO), VAT number: 09198410962, is the owner of the brand Diego dalla Palma, which markets and distributes all over the world through its stores and the website www.diegodallapalma.com (hereinafter "Website"), of which it is the owner.
These general terms and conditions of sale (hereinafter General Terms and Conditions), govern the purchase of Cosmetica Srl products (hereinafter Products), carried out remotely electronically through the Website. These purchases are reserved for users of the Website, residing in the territory of the European Union, who intend to make use of the Products’ sales services (hereinafter Customers).
The Customers are required to inform themselves and to read these General Terms and Conditions before completing a purchase on the Website. This information shall be deemed as read, understood and fully accepted by the Customer while placing a purchase order.
Therefore, the Customer shall comply with these General Terms and Conditions and Cosmetica Srl will have no liability for possible different conditions from the current ones that have not been agreed in advance in writing.
The Products available for online purchase on the Website are cosmetics.
All the Products are subject to availability. Cosmetica Srl reserves the right to change at any time the limits on the quantity and/or type of goods that can be purchased on the Website.
The Customer will be informed if its order could not be processed due to a lack of availability of the product.
The prices of the Products are expressed in € (Euro) on the Website and include all applicable taxes or duties. Delivery costs are excluded, unless otherwise indicated.
Cosmetica Srl constantly verifies that all the prices on the Website are correct, without guaranteeing the total lack of errors. In the event of an error in the product price, Cosmetica Srl will give the Customer the opportunity to confirm the purchase at the correct price or to cancel the order.
Cosmetica Srl reserves the right to carry out special purchase promotions or offers on the Products present on the Website. The conditions applied to the promotions will be regulated from time to time by Cosmetica Srl through specific communication to its Customers.

To complete a purchase on the Website it is not necessary to be registered as you can also do it as a non-registered guest.
For those who wish to register, the procedure requires to fill in an electronic form, entering in its fields the Customer's personal data and its e-mail address. The data will be processed according to the current legislation on privacy protection. Following registration, the Customer will be the holder of a personal account ,which can be accessed through a strictly confidential username and password. The assignment of these credentials guarantees the Customer an anonymous identification. It will be the Customer's responsibility not to disclose his password to third parties for any reason.
The Customer shall be held responsible for any irregular actions and behaviours which contravene regulations in force or these General Terms and Conditions committed by anyone who uses the personal account on its behalf. The Customer is required to promptly report to Cosmetica Srl any theft or loss of the password, as well as any incorrect use of the account or its password by third parties of which it has become aware.
The main characteristics and the prices of the Products are displayed in the offer for each Product present on the Website.
Conclusion of the contract
The Contract between Cosmetica Srl and the Customer shall be considered concluded when the order sent by the Customer reaches the address of the Website.
The order sent by the Customer will be binding for Cosmetica Srl only if the entire purchase procedure has been duly completed without any error messages from the Website.
Cosmetica Srl shall not be held responsible for malfunctions dependent on the data transmission system operator.
By sending the order to Cosmetica Srl, the Customer acknowledges and declares to have read all the information provided during the purchase procedure and to fully accept the General Terms and Conditions.
The purchase order form will be filed in the Website database for the period of time required to process the orders.
Cosmetica Srl will send the Customer, by e-mail, a confirmation of receipt of the purchase order sent by the Customer, containing the essential characteristics of the purchased Products, the date and time the order was made, the address of Cosmetica Srl, information on customer service and existing commercial guarantees, conditions on the right of withdrawal, detailed price indication, the payment method chosen by the Customer and the delivery costs. The Customer shall immediately verify the contents of the communication and immediately report any errors or omissions to Cosmetica Srl.
The Customer can pay for the Products and delivery costs via credit card, Paypal, bank transfer and cash on delivery.
Payment by credit card
For credit card payments, all financial information, such as card number, expiry date, etc., is directly handled by the Shopify Payments payment gateway, which guarantees the security of online transactions. Cosmetica Srl does not know the credit card data and for this reason cannot store them in any way.
Payment with PayPal
For payments with PayPal, all access information (user and password) are directly managed by PayPal, which guarantees the security of online transactions. Cosmetica Srl does not know the access data and is therefore unable to store them in any way.
Payment by bank transfer
If you choose to pay by bank transfer, once the order has been sent, the Customer must make the purchase indicating the order reference number, issued at the time of purchase, in the reason for payment.
The product will be shipped as soon as the payment has been verified (generally it takes up to 3 working days from the time it was made).

Cash on delivery:
If you choose to pay with cash on delivery, an extra charge of € 3.50 will be added to the total order. According to the cash on delivery regulation, customers must have the exact amount to give to the courier at the time of delivery, as the courier is not required to have cash to give change to customers.
Shipping and delivery
For the delivery of its purchases, the Customer can choose its residence or domicile, workplace, or private address of a natural person of its choice, whose residence or domicile is within the countries indicated in the Shipping page.
For safety reasons, no delivery will be made to PO boxes and the order will not be processed.
Delivery costs shall be paid by the Customer and are separately highlighted in the order form. They may vary depending on the chosen shipping method and the destination of the Products.
In general, all purchases are entrusted for delivery to the GLS courier (hereinafter, "Courier") on the working day following the date of conclusion of the order.
Orders will be processed and delivered from Monday to Friday, excluding non-working days and national holidays. Cosmetica Srl is not responsible for unforeseeable delays, it being understood that, except in cases of force majeure, the Products will be delivered within a maximum period of 30 (thirty) days from the day following that on which the Customer sent the order to Cosmetica Srl.
For the delivery of the goods to take place it is necessary that the Customer or a person in charge is present at the address indicated in the order. At the time of delivery by the Courier, the Customer is required to check:
(i) that the number of packages delivered corresponds to what is indicated in the transport document (DDT);
(ii) that the packaging is intact, not damaged, wet or otherwise altered, even in the sealing materials.
Any damage to the packaging and/or product or the mismatch in the number of packages shall be immediately notified, writing "goods received unchecked" on the Courier's proof of delivery. Once the Courier's document has been signed, the Customer cannot make any objection regarding the external features of the goods delivered.
If Cosmetica Srl is unable to deliver the ordered goods due to sudden and even temporary unavailability of the Products, it will promptly notify the Customer by e-mail, and in any case no later than 30 (thirty) days. The amount paid by the Customer will be refunded as soon as possible, and in any case no later that 30 (thirty) days from receipt of the purchasing order.
Cosmetica Srl will send the Customer a confirmation e-mail once the products have been entrusted to the courier.
To guarantee a safe delivery of the Product, Cosmetica Srl will keep the tracking number of every delivery.

Errors and inaccuracies
Cosmetica Srl aims to provide constantly updated information on the Website.
However, it is not possible to guarantee that the Website is completely free of any error. The Website may contain typing errors, inaccuracies or omissions, some of which may refer to the price and availability of the Product, and to the information sheet of the Product itself.
Cosmetica Srl reserves the right to correct any mistake, inaccuracy or omission also after the order has been placed and it also reserves the right to change and update the information at any time without notice.
Guarantee and authenticity
Cosmetica Srl guarantees the authenticity of all Products purchased on the Website. Diego dalla Palma products are made with the best raw materials, and comply with the current regulations applying to cosmetic products.
Amendments to general terms and conditions
These General Terms and Conditions are governed by Italian Law.
Cosmetica Srl reserves the right to change these General Terms and Conditions at any time. Any change, cancellation or addition will have immediate effect after their notification on the Website. Once the notification has been given, any access and use of the services provided by Cosmetica Srl is to be intended as full acceptance of the changes made.
For all disputes concerning the interpretation and execution of these General Conditions of Sale between Cosmetica Srl and the Customer, the judge of the consumer's place of residence or domicile shall be exclusively responsible for dealing with such disputes.
